An experienced admitted practitioner appearing as a self-represented party (or representing their own company) will not be afforded the usual allowances made for self-represented litigants when it comes to indemnity costs orders, particularly where they persist in running irrelevant arguments, re-agitating decided issues, and making personal attacks on opposing counsel over multiple hearing days despite judicial warnings. A party that seeks relief against a respondent (such as by notice to produce) cannot later characterise that respondent as a mere 'silent observer' to avoid a costs order.
