The Court struck out substantial portions of a statement of claim alleging Fair Work Act contraventions and whistleblower victimisation on the basis that allegations of unlawful conduct, contempt of court and professional misconduct were not pleaded with sufficient clarity and particularity. The Court held that where serious impropriety is alleged, including interference with the administration of justice, material facts must be pleaded with specificity even under modern case management principles. The Court permitted the applicant to re-plead the struck-out causes of action with appropriate amendments.
