Where a co-offender's sentencing judgment is tendered without objection at a sentence hearing, and the Evidence Act has not been directed to apply, the sentencing judge may rely on uncontroverted facts contained in that judgment (including facts from a statement of agreed facts in the co-offender's proceedings) as a sufficient evidentiary foundation for factual findings, at least where the fact is not seriously disputable and was not challenged by the offender's counsel. The broader question of the general evidentiary effect of a co-offender's sentencing judgment was expressly left open.
