A trial judge who repeatedly suggests that the prosecutor amend the indictment to add a charge, and then determines the application to amend, gives rise to apprehended bias vitiating the decision to grant leave. A judge's characterisation of the original indictment as resulting from 'incompetent bill finding' is an irrelevant consideration where the judge does not know the basis for the Director's charging decisions. A verdict of indecent assault is unreasonable where the complainant repeatedly denied physical touching and the only supporting evidence was inconsistent hearsay and DNA explicable by secondary transfer.
