For Commonwealth fraud offences under s 134.2 of the Criminal Code 1995 (Cth) involving amounts of approximately $36,000 obtained and $37,000 attempted, committed over a relatively short period using unsophisticated methods, an aggregate sentence of 4 years and 6 months' imprisonment is manifestly excessive. A sentencing judge's intervention to challenge an offender's credibility during evidence does not give rise to a miscarriage of justice, denial of procedural fairness, or apprehension of bias where the interventions arise from the offender's own answers and the offender is given the opportunity to explain.
