Mixed verdicts in domestic violence trials involving the same complainant are not necessarily inconsistent where acquittals are explicable by differences in corroborating evidence, different elements of the offences charged, and the jury's cautious approach to the burden of proof. The s 578A non-publication prohibition continues to operate in appeal proceedings even where the prescribed sexual offence charge is not itself under appeal, if publication would identify the complainant from the trial below.
