The power to extend the due day for completing an investigation under s 85(2) of the Health Ombudsman Act 2013 (Qld) cannot be exercised retrospectively after the due day has passed. Once the due day expires without completion or valid extension, the Ombudsman's investigative powers under Part 15 cease, but the Ombudsman retains the power to take other relevant action under s 38(1). Section 90 is engaged only by actual completion of an investigation, not by the mere expiry of the due day.
