When sentencing for fraud by dishonest inducement under s 408C(1)(c) of the Criminal Code (Qld), the benefit received by the offender (or lack thereof) remains a relevant consideration going to criminality, even though the charge is not framed under s 408C(1)(d) (gaining a benefit). A sentencing judge is not required to make a precise finding as to net profit where the evidence does not permit it, provided the overall scale of the fraud is properly characterised.
