A substantially successful party that fails on a discrete but substantial issue will typically have its costs reduced by a modest percentage (here, 5% on appeal and 10% at first instance) rather than losing costs on an issue-by-issue basis. However, failing on individual points along the way to obtaining the intended outcome does not warrant any costs reduction unless the submissions were inordinately time-consuming, frivolous, or vexatious.
