Where an appellant succeeds on one of two distinct claims on appeal, the court may make a broad assessment of costs reflecting relative success rather than ordering costs to follow the event or apportioning strictly by reference to grounds of appeal. The proportion of the appeal actually devoted to the successful claim, and the public interest significance of the outcome, are relevant considerations.
