An applicant sentenced on agreed facts cannot challenge those facts on a sentence appeal, and psychiatric evidence not tendered at sentencing (despite being available) will not be received on appeal to support a manifest excess ground. An alleged agreement between prosecution and defence as to sentence range cannot bind the sentencing judge.
