A question proposed for referral to a medical panel under s 49(3) of the Workers Rehabilitation and Compensation Act 1988 (Tas) does not cease to be a 'medical question' merely because it involves disputed facts or competing contentions. The function of a medical panel is to form its own opinion by applying its own medical experience and expertise, not to adjudicate between competing contentions. A question of whether a medical expense was incurred 'as a result of' a compensable injury is a question 'relating to a medical service provided to a worker for an injury' within paragraph (g) of the definition of 'medical question' in s 3.
