Any sexual touching of a child by a person in a position of trust is to be viewed as very serious irrespective of which part of the body is touched, and there is no hierarchy of seriousness between touching breasts and touching genitals in such cases. Rolled-up charges of sexual assault are, other things being equal, more serious than single offence charges. Appellate courts will not entertain departures from considered concessions made by defence counsel on the plea absent exceptional circumstances.
