A non-parole period of 81% of the total effective sentence for culpable driving causing death was manifestly excessive where the offender had promising rehabilitation prospects and no express reason was given for exceeding the statutory minimum proportion. The statutory minimum non-parole period under s 11A(4)(c) of the Sentencing Act 1991 (Vic) is a floor, not a ceiling, but a disproportionately high non-parole period invites appellate scrutiny and must be justified by the circumstances.
