In a judge-alone criminal trial, the adoption of prosecution submissions can satisfy the statutory requirement under s 68C(2) to expose the reasoning process, provided the submissions are comprehensive and cogently analyse the central issues, and the judgment is read as a whole. The adequacy of reasons cannot be assessed by reference to the structure of the judgment alone but must be considered by reference to the materiality of the particular intermediate findings. The proviso may be applied where a miscarriage of justice results from inadequate reasons but the appellate court is satisfied on its own review that there is no risk an innocent person has been convicted.
