The offence of choking under s 28(2)(a) of the Crimes Act 1900 (ACT) requires proof of intention; recklessness is insufficient. Where a Magistrate applies the wrong legal test and the factual findings are insufficiently clear to enable the appellate court to apply the correct test, remittal rather than acquittal is the appropriate disposition.
