Expert opinions on liability should ideally be obtained before commencing proceedings. Directions for service of expert evidence should be sought at an early stage and well in advance of the listing hearing. Where a late application to rely on an expert report is likely to disrupt the hearing date, the Court should be slow to grant leave. After commencement of a hearing, exceptional circumstances must be established under r 1241(4) to rely on a report not served in accordance with r 1205.
