Employers bound by pre-modernised federal awards that contain long service leave provisions (even if those provisions exclude casual employees) are subject to Fair Work Act provisions that exclude the operation of State and Territory long service leave legislation in relation to those employees; casual employees covered by such awards have no entitlement to long service leave under either the federal award or State/Territory legislation.
