Holding a solicitor's practising certificate does not preclude the Bar Council from independently assessing fitness under s 45(2) of the Uniform Law when an application is made for a barrister's practising certificate, and failure to exercise the statutory right of merits review under s 100 may result in discretionary refusal of judicial review relief.
