An offender's deprived childhood, mental health conditions, and resulting alcohol dependence impact moral culpability but do not reduce the objective seriousness of the offence unless there is more than a simple or indirect causal connection between the subjective feature and the offending. The Whyte dangerous driving guideline judgment applies to dangerous navigation offences only by analogy, and the analogy is imperfect for non-motorised watercraft such as kayaks. Sentencing judges are not required to place objective seriousness on a putative scale from low to high range.
