Starting points for indicative sentences that are only two months short of the maximum penalty are not appropriate where the offending is found to be at or just above the mid-range of objective seriousness, even where the offending is grave and the subjective case is limited. Grounds of appeal attacking aggregate sentences on the basis of errors in indicative sentences are not prohibited. The anomalous ratio between SNPP and maximum penalty for s 61M offences does not justify starting points approaching the maximum.
