For offences of sexual intercourse with a child under 10 (s 66A Crimes Act 1900) assessed at mid-range objective seriousness after trial, indicative sentences in the range of 6.5 to 7.5 years are manifestly inadequate; the appropriate range, as demonstrated by the resentencing and comparable cases, is approximately 8 to 11 years. An aggregate head sentence that is less than the standard non-parole period for a single count of the most serious offence constitutes an affront to the administration of justice. The residual discretion will not be exercised where the sentence is significantly inconsistent with recent authority that was cited to the sentencing judge.
