Generalised fears of culturally motivated violence, without evidence of specific threats or demonstrated risk in the relevant jurisdiction, are insufficient to establish that suppression orders are 'necessary to protect the safety of any person' under s 8(1)(c) of the CSNPO Act. The geographic limitation of orders under s 11 (which cannot extend beyond the Commonwealth) significantly reduces their utility where the persons at risk are located overseas. Expert evidence on cultural practices is of little weight where it is not based on specific information about the applicant's circumstances and extended family.
