A weak prosecution case (assessed as no higher than 'viable') combined with unmet medical needs in custody can establish cause under s 16A of the Bail Act 2013 (NSW), but bail may still be refused where the applicant's criminal history, connections with organised crime, access to resources, and prior conviction for perverting the course of justice establish unacceptable risks that cannot be ameliorated by bail conditions, no matter how stringent.
