An admission in pleadings that a doctor 'opined' a particular diagnosis is an admission of the fact that the opinion was expressed, not an admission of the diagnosis itself. A workers' compensation tribunal's preference for one expert over another, supported by articulated reasons (even if brief), does not constitute an error of law susceptible to appeal. An expert report prepared with reference to an initial injury and triggered by a Notice of Decision is not temporally constrained to the date of the report.
