The exception to indefeasibility for misdescribed easements under s 189(1)(c) of the Land Title Act 2000 (NT) is confined to easements that have been validly created by registration and subsequently misdescribed in the register. A discrepancy between the dimensions of an easement shown on a development permit drawing and those shown on the registered plan of subdivision does not constitute a 'misdescription' within the exception, because the development approval does not create a right in rem. The only 'particulars' of an easement created by registration of a plan of subdivision are those shown on the registered plan. Parties who wish to ensure an easement is registered in specific dimensions must verify the survey plan before registration, as the remedy after registration lies in personam rather than through rectification of the register.
