Where a party has limited success on a short point on appeal but fails on the substantial issues, an overall costs apportionment of 95% against that party may be appropriate. An appellate court's discretion to vary a trial costs order is enlivened where the order was made on the premise of a certain outcome that was found to be incorrect on appeal, but the court may decline to vary the order where the overall discount remains appropriate.
