A trial judge must give clear and consistent directions on post-offence conduct, must not refer to matters not relied upon by the Crown as post-offence conduct, and must direct the jury on central disputed evidence (such as alleged congratulatory conduct) including the factual finding required and the permissible uses of that evidence. Failure to do so may occasion a miscarriage of justice warranting retrial.
