Section 34(4) of the Jury Act 1995 (Qld) gives the trial judge a genuine choice between selecting a replacement reserve juror by lot or by another method decided by the judge; the provision does not preference or require selection by lot. The change in language from s 17(4) of the Jury Act 1929 (Qld) to s 34(4) of the 1995 Act was a deliberate change of meaning.
