The preservation of accrued rights under a contract is consistent with a finding that the parties mutually abandoned their future obligations. Where a contract has been partly performed, the abandonment operates prospectively without prejudice to accrued entitlements, but the cause of action for those accrued entitlements runs from the date of abandonment for limitation purposes. Costs incurred in unsuccessful foreign proceedings do not fall within a contractual indemnity for losses suffered 'as a result of breach' where the proceedings failed on jurisdictional grounds unrelated to the breach.
