Where an unsuccessful appeal by a workers' compensation insurer involves a novel, policy-laden or scheme-sensitive question of statutory construction under the WCRA, and the respondent is an impecunious litigant, indemnity costs will be awarded. The difference between indemnity and standard costs should not fall to be deducted from the statutory compensation to which the worker is entitled.
