An applicant for leave to appeal who has very poor prospects of success, advances no new argument, and rejects a reasonable settlement offer under Chapter 9 Part 5 of the UCPR may be ordered to pay indemnity costs. A prior award of indemnity costs at trial based on a different offer is not relevant to the costs question on the leave application.
