An event organiser who uses barriers to separate categories of participants elsewhere on a course may be found to have breached its duty of care by failing to use similar barriers at a known pinch point where different categories of participants with different speed capacities share the course. Expert evidence is not required to establish the reasonableness of such a precaution where the organiser's own practices demonstrate its feasibility. A trial judge assessing breach must weigh the risks associated with the proposed remedial step, but is entitled to reject evidence that barriers would create greater danger where that evidence is not persuasive.
