A claim of significant forensic disadvantage under s 132BA of the Evidence Act 1977 (Qld) based on inability to forensically examine clothing will fail where the clothing would have been laundered in the ordinary course regardless of the delay in prosecution. The loss of evidence that would have been lost irrespective of the delay does not constitute a forensic disadvantage caused by the delay.
