Entering a dwelling and depriving a person of liberty in circumstances that are not premeditated, do not involve weapons, and are not committed for the purpose of robbery or sexual offending should not be sentenced as a 'home invasion'. Where comparable authorities involving premeditated burglary in company while armed attract sentences in the range of two and a half to four years, a sentence of three and a half years for less serious offending of this nature is manifestly excessive. Common assault counts that form particulars of a deprivation of liberty offence should not attract separate sentences, even if concurrent.
