A void Crown lease, including one void for failure to comply with the advertising requirement in s 137 of the Land Act 1958, confers indefeasible title upon registration under the Transfer of Land Act 1958, subject only to statutory exceptions and established in personam rights. A public law right to seek judicial review of a void Crown grant does not constitute an in personam right enforceable against the registered proprietor. The decision in Forrest & Forrest Pty Ltd v Wilson concerning 'informality or irregularity' in the Mining Act 1978 (WA) does not affect the well-established Torrens principle that registration of a void instrument confers indefeasible title. Part I of the Land Act 1958 applies to the sea-bed beneath coastal waters of Victoria.
