A stay of a separate proceeding should not be used as a means of enforcing a judgment debt unless allowing the proceeding to continue would work a relevant injustice. The weakness of a fraud case does not alone constitute an abuse of process justifying a stay. Less drastic means such as enforcement of the judgment debt and security for costs should be exhausted before a court stays a proceeding to enforce compliance with an undertaking.
