Brief, general and inadmissible evidence of prior bad conduct given during evidence in chief does not result in a substantial miscarriage of justice where the trial judge gives a timely and clear direction to the jury to disregard it, particularly where the inadmissible evidence is outweighed by specific admissible evidence of similar conduct within the charged period. Incest offending involving multiple victims, breach of trust, escalation, associated violence, and significant victim impact is properly characterised as in the upper range of seriousness.
