A completely hopeless interlocutory injunction application provides a sufficient standalone basis for a costs order against the applicant. An application for leave to appeal against such a costs order, where the applicant advanced no submissions opposing costs at first instance and raises no arguable error, will be refused and may be certified as totally without merit under s 14D(3) of the Supreme Court Act 1986 (Vic).
