On resentencing following breach of a CCO under s 83AS of the Sentencing Act 1991 (Vic), substantial compliance with punitive conditions of the original CCO (completion of community work hours and payment of fine), combined with significant delay since offending, absence of further offending, psychological conditions attracting Verdins principle 5, and good character, may render a sentence of 18 months' imprisonment manifestly excessive for possession of cocaine for the purpose of trafficking where the offending was driven by drug dependence. A sentence of 8 months' imprisonment was substituted.
