A sentencing judge must not take into account, as part of the offence for which the offender is being sentenced, conduct that falls outside the charge period and is not particularised in the indictment, even where that conduct is factually related to the charged offence. The provision of fraudulently altered documents to the prosecution is a particularly serious form of attempting to pervert the course of justice, warranting significant weight being given to general deterrence and denunciation.
