Time spent in immigration detention in a prison, with consequent deprivation of liberty, falls squarely within the Renzella discretion and must be factored into the sentencing synthesis. Whether such time is characterised as falling within the Renzella discretion or the totality principle is simply a matter of labels. An error in the calculation of such time is of sufficient significance to constitute appellable error and reopen the sentencing discretion.
