Beach JA granted a non-publication order under s 18(1)(c) of the Open Courts Act 2013 prohibiting disclosure of the identity of a respondent to a s 317 Criminal Procedure Act 2009 application, on the basis that the respondent's fears for their safety and that of their family were genuine and well-founded given allegations linking them to police informant activity. The Court held that the specific safety concerns were sufficient to displace the principle of open justice in the limited manner sought, and noted the order did not prejudice the applicant's preparation of his leave to appeal application.
