A combination of the time of night, location in a high drug activity area, and observation of a zip-lock bag in a vehicle's centre console can constitute reasonable grounds for suspicion under s 82 of the Drugs, Poisons and Controlled Substances Act 1981 (Vic), sufficient to justify a warrantless search. A judge's use of the word 'might' in describing the requisite suspicion does not establish legal error where the ruling as a whole demonstrates correct application of the statutory test.
