Where an appellate court's reasons risk breaching s 166 of the Family Violence Protection Act 2008 (Vic), the court may publish redacted reasons omitting material that could constitute a report of proceedings under the Act, even without an order under s 169. On reassessment of defamation damages following partial appellate success, the court will confine the reassessment to the grounds upheld and will not entertain wider challenges to the damages award absent a cross-appeal. The question of which court has power under s 169 to authorise publication otherwise prohibited by s 166 remains open.
