An expert witness's lay observation of odour at a fire scene does not constitute expert opinion evidence and need not be included in an expert report under Practice Note SC CR3 where it does not form part of the basis of the expert's opinion. Prejudice arising from an expert's use of quantitative descriptors for non-quantitative test results is curable by judicial direction.
