The Court of Appeal held that a purported appeal under s 10(1)(c) of the Supreme Court Act 1986 against a summary conviction determined by the County Court in its appellate jurisdiction was incompetent. The Criminal Procedure Act 2009 is the exclusive source of appellate jurisdiction in criminal cases, and s 10(1)(c) applies only to civil proceedings under s 74 of the County Court Act 1958. Once a person convicted summarily exercises the right of appeal to the County Court under s 254 of the Criminal Procedure Act 2009, appellate rights are exhausted unless the narrow exception in s 283(2)(a) applies (imprisonment imposed on appeal where the Magistrates' Court had not ordered imprisonment).
