A purchaser seeking specific performance of a contract of sale need not have the purchase price immediately available at all times; it is sufficient to have access to funds when performance falls due. The failure of a solicitor to respond to an opposing solicitor's request for evidence of a client's financial capacity does not, without more, permit an adverse inference under Jones v Dunkel principles, particularly where there is an obvious explanation for the non-response.
