A trustee's failure to proactively seek judicial advice when questions arise about trust administration may disentitle it to costs even where it is ultimately successful in defending proceedings brought by a beneficiary. Where a proceeding is intimately bound up with questions of trust administration, all parties' costs may be ordered from the trust fund even though the proceeding is adversarial in character and does not fit neatly within the Buckton categories.
