The M v The Queen test for unreasonable verdict remains the sole applicable test; shorthand metaphors such as 'solid obstacle' (Shah) do not add any gloss or additional requirement. In a circumstantial murder case, DNA evidence on a moveable object (ammunition box) found in a getaway vehicle, combined with CCTV tracking of the accused's movements and physical similarities between the accused and the offender, was sufficient to exclude any hypothesis consistent with innocence.
